1. Overview
MVMusics Labs, Inc. ("MVMusics," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines our procedures for responding to notices of alleged copyright infringement in accordance with the DMCA.
MVMusics operates as a digital music distribution platform. We distribute content provided by our users to various streaming platforms and digital stores. We take copyright infringement seriously and will respond to clear notices of alleged infringement.
If you believe that your copyrighted work has been copied and made available through our Service in a way that constitutes copyright infringement, please follow the procedures outlined in this policy to submit a notification.
2. Copyright Infringement Claims
If you are a copyright owner, or authorized to act on behalf of a copyright owner, and believe that your copyrighted work has been infringed through our Service, you may submit a DMCA takedown notice to our designated Copyright Agent.
To be effective, your notification must be in writing and include the following information:
(a) A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
(b) Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
(c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide specific URLs, track titles, artist names, ISRC codes, or other identifying information.
(d) Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
(e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
(f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Submitting a DMCA Notice
DMCA takedown notices should be sent to our designated Copyright Agent:

For fastest processing, we recommend submitting notices via email. Please use the subject line "DMCA Takedown Notice" and ensure all required information is included.
Upon receipt of a valid DMCA notice, we will:
(a) Acknowledge receipt of your notice within 2 business days.
(b) Review the notice for completeness and compliance with DMCA requirements.
(c) If the notice is complete, we will expeditiously remove or disable access to the allegedly infringing material.
(d) Notify the user who uploaded the content of the takedown and provide them with information about filing a counter-notification.
(e) Notify our distribution partners to remove the content from their platforms.
4. Counter-Notification Procedure
If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our Copyright Agent.
Your counter-notification must be in writing and include the following:
(a) Your physical or electronic signature.
(b) Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
(c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
(d) Your name, address, telephone number, and email address.
(e) A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of Delaware if your address is outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receipt of a valid counter-notification, we will:
(a) Promptly provide the complainant with a copy of the counter-notification and inform them that we will replace the removed material or cease disabling access to it in 10 business days.
(b) Replace the removed material or cease disabling access to it within 10 to 14 business days following receipt of the counter-notification, unless our Copyright Agent receives notice from the complainant that they have filed a court action seeking to restrain the user from engaging in the infringing activity.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, MVMusics has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.
MVMusics will terminate a user's account if the user is determined to be a repeat infringer. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had content removed from the Service more than twice.
Our repeat infringer policy includes the following measures:
(a) First Infringement: Warning notice sent to the user. Content removed from the Service.
(b) Second Infringement: Final warning notice. Content removed. Account placed on probation. User may be required to provide additional verification before uploading new content.
(c) Third Infringement: Account terminated. User permanently banned from the Service. All content removed. Any pending royalties may be forfeited.
We reserve the right to terminate accounts after fewer than three strikes if the circumstances warrant immediate action, such as cases of willful infringement, mass infringement, or commercial piracy.
Users whose accounts have been terminated for repeat infringement may not create new accounts without our express written permission.
6. Misrepresentation Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.
Before submitting a DMCA notice or counter-notification, you should consider whether the allegedly infringing use constitutes fair use. We recommend consulting with an attorney if you are unsure whether your copyrighted material has been infringed or whether the material you uploaded constitutes infringement.
Please be advised that we may share information from DMCA notices and counter-notifications with the parties involved and may include such information in any court filing.
Fraudulent or bad faith DMCA claims may result in account termination and potential legal liability.
7. Distribution Partners and Third-Party Platforms
Content distributed through MVMusics is made available on third-party streaming platforms and digital stores, each of which has its own DMCA policies and procedures.
When we receive a valid DMCA notice, we will request removal of the content from all distribution partners. However, we cannot guarantee immediate removal from all platforms, as each platform has its own processing timelines.
If your copyrighted work appears on a third-party platform and you believe it was distributed through MVMusics, you may submit a DMCA notice to us and/or directly to the third-party platform.
Common distribution partners include but are not limited to: Spotify, Apple Music, Amazon Music, YouTube Music, Deezer, Tidal, Pandora, SoundCloud, and various other streaming services and digital stores.
Please note that even after content is removed from our Service and distribution partners, cached copies may temporarily remain accessible on some platforms.
8. Content Identification Systems
Some of our distribution partners use content identification systems (such as YouTube Content ID) to automatically detect and manage copyrighted content.
If you are a copyright owner and wish to register your content with these identification systems, you may need to work directly with the platforms or through authorized representatives.
MVMusics is not responsible for claims made through third-party content identification systems. If you receive a claim through such a system related to content distributed through MVMusics, please contact both us and the relevant platform.
We recommend registering your original content with content identification systems to help prevent unauthorized use and to facilitate easier resolution of disputes.
9. Good Faith and Fair Use
We encourage all parties to consider good faith and fair use principles when evaluating potential copyright claims.
Fair use is a legal doctrine that permits limited use of copyrighted material without acquiring permission from the rights holders. Factors considered in fair use analysis include:
(a) The purpose and character of the use, including whether such use is commercial or for nonprofit educational purposes.
(b) The nature of the copyrighted work.
(c) The amount and substantiality of the portion used in relation to the copyrighted work as a whole.
(d) The effect of the use upon the potential market for or value of the copyrighted work.
If you believe your use of copyrighted material constitutes fair use, you may include this information in your counter-notification. However, fair use is a complex legal doctrine, and we recommend consulting with an attorney.
10. International Copyright
While this policy is based on United States copyright law and the DMCA, we respect copyright laws in all jurisdictions where we operate.
If you are located outside the United States and believe your copyright has been infringed, you may submit a notice using the procedures outlined in this policy, or you may contact us to discuss alternative procedures that may be available under the laws of your jurisdiction.
For notices from European Union residents, we also comply with the EU Copyright Directive and relevant member state implementations.
Please include in your notice the jurisdiction whose copyright law you are invoking, if different from the United States.
11. Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to this page.
We will notify registered users of material changes to this policy via email or through the Service.
Your continued use of the Service following any changes to this DMCA Policy constitutes acceptance of those changes.
We recommend reviewing this policy periodically to stay informed of our copyright practices.
